Semi and Truck Collisions

Truck accidents and collisions may involve crashes between semi-tractor trailers, stake bodied trucks, pickup trucks or automobiles. For semi-tractor trailers and some stake bodied trucks involved, there are federal regulations applicable to their operation with which we are familiar and with which we have dealt. For example, there are load limits and maximum duty hours applicable to drivers. Drunk Driver

Many motor vehicle accidents are caused by drunk drivers. When we are employed, we closely follow the legal proceedings involving the charge of driving under the influence so as to be able to maximize its effect in our client’s civil case against the drunk driver. Also frequently involved in these cases is the need for expert testimony regarding the effect of the blood alcohol percent on the driver’s ability as a driver and we have access to such experts.

Rear-end Collisions

One of the favorite defenses that insurance companies use when insured driver’s rear end others is the claim that “there is little or no damage so there is little or no injury.” This is what we call “junk science” and we know the experts who can refute such a claim when rear-end collisions occur.

Roll-overs

The typical roll-over case is a one car event although it can result from a collision. In a roll-over, a roof collapse can cause catastrophic injuries such as quadriplegia or even death. This situation may involve both the driver and any passenger. In any roll-over case, there may be a claim against the vehicle manufacturer. This is a product liability claim and requires prompt action to obtain the vehicle and an examination and evaluation of the vehicle by experts who we can quickly obtain. If the roll-over involves a passenger, there may also be a claim of negligence on the part of the driver.

Uninsured and Under-insured Claims

If you carry automobile liability insurance, you have the option of purchasing at a very small cost uninsured and under insured motorists coverage. This insurance essentially provides liability insurance coverage for a driver who injures you and who either is not insured or whose liability insurance limits are not sufficient to compensate you for your injuries or death if that is involved. As part of representing you in your claim against another driver, we will, at no additional fee, represent you in a claim against your insurance company if the other driver is uninsured or has liability coverage which is inadequate to compensate you for the injuries or any death involved.

Motorcycle accidents

Motorcycle accidents generally occur when drivers are not alert when it comes to spotting motorcyclists. This is particularly true when a motorist enters onto a thru-roadway and a motorcycle is approaching and entering that intersection on the thru-roadway. A motorcyclist is literally unprotected and injury and death can and does occur.

Bus accidents

Buses are required to follow the same rules of the road as other drivers and the owner and its operator are liable for injury or death caused by failure to do so.

Bicycle accidents

Under Indiana law, bicycle riders have a right to use streets and highways and have the same rights and obligations as the operator of a motor vehicle. I.C. 9-21-8-37 states:

“Notwithstanding other provisions of this article or a local ordinance, a person who drives a vehicle shall do the following:

(1) Exercise due care to avoid colliding with a pedestrian or a person propelling a human powered vehicle, giving an audible signal when necessary.”

Consequently, motorists are required to see and appreciate that which can be seen and appreciated in the exercise of reasonable care and are required to operate their motor vehicles with reasonable care to avoid bicycle accidents.

Types of Insurance

Automobile liability policies may provide you with different forms of protection depending upon what you purchase.

1. Liability Coverage

If you own a motor vehicle registered in Indiana, you must purchase a policy which provides at least $25,000/$50,000 coverage. This means your policy must provide $25,000 per person per accident and $50,000 for all persons injured in any one accident.

2. Property Damage

You may purchase this coverage which pays for accidental damage to your vehicle in a collision and usually involves a deductible.

3. Medical Payments Coverage

You may purchase medical payments coverage as a part of your automobile liability policy which will pay the selected amount of coverage to you or any passenger in your vehicle injured in an accident with that vehicle.

4. Comprehensive

Comprehensive coverage covers a number of incidents other than collision involving your vehicle, the most typical of which is vandalism to your vehicle.
